The author, Professor Gao Tong of Nankai University, listed the practical difficulties in identifying and proving virtual currency involved in criminal cases, including: 1. Strengthen the review of the capital flow process between legal currency and virtual currency: focus on verifying the "legal currency-virtual currency" two-way conversion and inter-currency transaction records, compare transaction hash values, timestamps and other data, and establish cross-currency capital associations. 3. Appropriately simplify the proof method of the virtual currency involved in the case and adopt differentiated proof standards: adopt the "sufficient evidence" standard for conviction and sentencing, and apply the "high probability" standard for property disposal; allow for simplified methods such as comprehensive identification and sampling proof for massive data. 4. Improve the comprehensive identification mechanism for the value of the virtual currency involved in the case: comprehensively consider factors such as transaction price, victim's cost, and market price at the time of the incident, establish an open and transparent price identification procedure, and protect the rights of the parties.
