PANews reported on April 27 that the Procuratorate Daily recently published an article titled "Improving the Identification and Proof Mechanism of Virtual Currency Involved in Criminal Cases". The author, Professor Gao Tong of Nankai University, listed the practical difficulties in identifying and proving virtual currency involved in criminal cases, including: 1. The direct correlation between the virtual currency involved and the facts of the crime is weakened, and the proof of the virtual currency involved is more dependent on verbal evidence such as confessions; 2. The capital flow of the virtual currency involved is complex and changeable, and it is difficult to determine the complete capital flow; 3. The accurate identification of the value of the virtual currency involved faces difficulties. In this regard, the author proposed suggestions for improving the identification and proof mechanism of virtual currency involved in criminal cases: 1. Use diversified evidence chain analysis methods to consolidate the evidence basis of virtual property involved in the case: integrate traditional evidence (such as confessions, testimonies) and blockchain technology (chain tracking, wallet analysis), restore the capital path through professional tools, and lock in the parties. 2. Strengthen the review of the capital flow process between legal currency and virtual currency: focus on verifying the "legal currency-virtual currency" two-way conversion and inter-currency transaction records, compare transaction hash values, timestamps and other data, and establish cross-currency capital associations. 3. Appropriately simplify the proof method of the virtual currency involved in the case and adopt differentiated proof standards: adopt the "sufficient evidence" standard for conviction and sentencing, and apply the "high probability" standard for property disposal; allow for simplified methods such as comprehensive identification and sampling proof for massive data. 4. Improve the comprehensive identification mechanism for the value of the virtual currency involved in the case: comprehensively consider factors such as transaction price, victim's cost, and market price at the time of the incident, establish an open and transparent price identification procedure, and protect the rights of the parties.
